ARTICLE 1 - GENERAL PROVISIONS
The General Booking Conditions outlined in this document apply to all products and services provided by CADDY MASTER MOROCCO. The customer commits to adhering to these General Booking Conditions, which they have reviewed and unreservedly accepted prior to making a reservation.
These General Conditions shall be fully effective and shall prevail over any other provisions unless explicitly waived in writing by CADDY MASTER MOROCCO.
ARTICLE 2 - TRAVEL CONTRACT
2.1 Contracting Party
The travel contract is entered into with CADDY MASTER MOROCCO, depending on the type of product(s) or service(s) the customer reserves. When the reservation is made through a third-party service provider, CADDY MASTER MOROCCO acts as an intermediary between the customer and this service provider. The contract will thus be subject to the General Terms and Conditions of Sale of this provider, who may limit or exclude their liability without this leading to an increase in our own liability.
Customers may, if needed, refer to the website of each provider for the General Terms and Conditions applicable to consumer clients or request additional information from their travel advisor.
In any case, CADDY MASTER MOROCCO will only consider claims involving its direct and proven liability.
2.2 Contract Conclusion
All reservations are made subject to availability.
The customer has the opportunity to review the content and total price of their reservation as well as correct any potential errors before confirming their order.
Unless otherwise stipulated in these General Booking Conditions, the contract will come into effect as soon as CADDY MASTER MOROCCO has received the customer's effective payment.
The customer acknowledges having reviewed these General Terms and Conditions of service provision and having examined the conditions of the offer before proceeding to confirm the purchase of the service and its payment.
It is the customer's responsibility to print or save all contractual documents.
A copy of the contract will automatically be stored in the records of CADDY MASTER MOROCCO. Customer data are processed in accordance with the provisions of Law No. 09-08 concerning the protection of individuals with regard to the processing of personal data.
The customer acknowledges being informed that there may be booking fees per reservation file and/or per person, depending on the product reserved.
The customer will be informed of any potential fees at the time of confirming their reservation. These booking fees may be modified without notice and can be increased, reduced, or removed.
ARTICLE 3 – TRIP RESERVATION
All offers are subject to availability and can be withdrawn at any time. When making a reservation, the client guarantees that they accept these terms on their behalf and/or on behalf of several individuals. If the client makes a reservation for more than one person, they guarantee to be jointly responsible for all payments due by each of the individuals for whom they make the reservation. It is the client's responsibility to ensure that any information provided to them by CADDY MASTER MAROC or by one of CADDY MASTER MAROC's suppliers is passed on to all individuals. Any information provided to the client will be considered as being provided to all individuals for whom they have made or are making a reservation.
ARTICLE 4 – PAYMENT
Payment for services available on the website www.igolfmorocco.com is made through Payzone using Visa and Mastercard. As part of the prevention against credit card fraud, and to protect the client against fraudulent use of their payment methods, CADDY MASTER MAROC may request additional documents, including:
- If the client wishes to make a reservation with one of CADDY MASTER MAROC's agencies or via the CADDY MASTER MAROC call center, they reserve the right to ask the client to provide the following:
- A simple copy of the ID of the payment method holder ;
- A simple copy of the bank card if payment is made by credit card. If these documents are not received within forty-eight (48) hours following the reservation request, the order may be canceled by CADDY MASTER MAROC, in which case the reservation will be considered as never having existed. If the client wishes to make a reservation on the website www.igolfmorocco.com: CADDY MASTER MAROC reserves the right to ask the client, before processing their reservation request, to provide the following:
- Proof of residence dated less than three months;
- An identity verification form duly completed and signed by the person making the card payment;
- A simple copy of the ID of the bank card holder;
- A simple copy of the bank card. If these documents are not received within forty-eight (48) hours following the request, CADDY MASTER MAROC reserves the right not to proceed with their reservation request.
ARTICLE 5 – TRAVEL DOCUMENTS
5.1 Electronic Tickets (e-ticket)
As of June 1, 2008, following the decision of the International Air Transport Association (IATA) and all airlines, travel agencies are no longer allowed to issue paper tickets.
This means that CADDY MASTER MAROC can only issue electronic tickets (e-ticket).
When CADDY MASTER MAROC cannot issue an electronic ticket, the acceptance of the reservation will be subject to the ability to obtain from the supplier a transport title in a format accepted and recognized by international conventions. If the supplier cannot issue the ticket in any form, CADDY MASTER MAROC will cancel the client's order, and the reservation will be considered as never having existed.
In the event of a cancellation of the client's reservation, CADDY MASTER MAROC, solely for informational purposes and without any obligation of result, will inform the client of offers equivalent to the canceled order to facilitate their new reservation.
5.2 Exchange Vouchers (Voucher)
The voucher is issued by travel advisors duly authorized by CADDY MASTER MAROC to allow the client to consume the paid service(s).
The voucher and the rights attached to it are neither transferable nor exchangeable. The voucher can also be issued by CADDY MASTER MAROC in its capacity as an intermediary instead of the supplier. The supplier's general terms and conditions of sale are then mentioned on this document, or if they are not, the travel advisors will provide any necessary information for informational purposes.
ARTICLE 6 – MODIFICATION BY THE CLIENT
Any modification request is subject to availability and the limitations and restrictions provided by CADDY MASTER MAROC.
Modifications must be requested by the client by contacting the sales advisor or the CADDY MASTER MAROC call center at the following number: +212 (0) 7 16 55 59 26
If the modification results in an increase in the reservation price, the client will have to pay the additional costs plus modification fees. However, if the reservation price is lower after modification, the difference is refunded, taking into account the modification fees.
In all cases, if the client wishes to modify all or part of their reservation, CADDY MASTER MAROC's file fees will apply, unless a special mention or waiver specifies the specific conditions applicable to the reservation.
ARTICLE 7 – CANCELLATION BY THE CLIENT
In the event of a reservation cancellation, administrative fees, service fees, insurance, and modification fees are non-refundable.
The aforementioned cancellation fees are determined based on the nature of the purchased service and the general terms and conditions of the provider for which CADDY MASTER MAROC acts as an intermediary. It is the client's responsibility to inquire with their travel advisor. When the client does not opt for a refund to be used for a future service, CADDY MASTER MAROC also applies cancellation fees of up to 20% of the service amount, unless a special mention or waiver specifies the specific conditions applicable to the reservation.
ARTICLE 8 – FAILURE TO CHECK-IN OR NO SHOW
If the client has a reservation for one of CADDY MASTER MAROC's products or services but does not show up for check-in to avail of said product or service, they will not be eligible for a refund.
ARTICLE 9 – INSURANCE
9.1 Insurance Contract
It is the client's responsibility to take out adequate insurance to cover (at a minimum) expenses incurred in the event of cancellation and the costs of assistance, including repatriation, in the event of an accident or illness abroad. It is also the client's responsibility to comply with the insurance company's requirements and to provide them with all accurate and necessary information when taking out the contract.
Sales of packaged products (including flight, transfer, accommodation, and/or tour) include travel assistance insurance, the terms and features of which are defined in the general conditions provided by the insurance company, and the client declares to be informed of them.
It is important to note that CADDY MASTER MAROC is in no way responsible for criminal offenses committed by its employees, agents, and suppliers unless there is gross or intentional misconduct on the part of CADDY MASTER MAROC as an intermediary.
9.2 Cancellation of the Insurance Policy
All insurances must be taken out and paid for at the time of booking and are non-refundable.
ARTICLE 10 – INFORMATION, PASSPORTS, VISAS, AND HEALTH
It is the client's responsibility to inform themselves about the health risks related to the destination country(ies). The client should seek advice regarding vaccinations and precautions that may be mandatory or recommended from a specialist (such as a general practitioner, nurse, pharmacist, or a travel clinic) ideally at least 8 weeks before the departure date.
It is the client's responsibility to:
- Check with the relevant embassy or consulate if they need a visa to enter their destination(s);
- Obtain the appropriate visa for their destination(s) and any transit points. If the client fails to complete these formalities, they will be solely responsible for any costs, losses, or damages incurred by themselves or CADDY MASTER MAROC due to this oversight.
The client must include all stages of their journey, which might also require a visa. It should be noted that many countries may require the client's passport to be valid for at least six months beyond their stay. Some countries have different regulations, so the client should contact the embassy or consulate of their destination to get precise and up-to-date information.
The client must ensure their passport is readable and intact. Any signs of damage could result in being denied boarding or entry into the destination country.
The name on the passport must match the name on the ticket. Otherwise, the client may be unable to travel, and insurance might be void.
ARTICLE 11 – HOTEL/ACCOMMODATION BOOKING ONLY
11.1 Star Rating
The star rating symbolizes the overall quality, level of service, dining, and amenities offered by the establishment. The ratings in each country vary based on specific criteria applied by the local rating agency and are provided for informational purposes only. They do not constitute any guarantee of any kind on the part of CADDY MASTER MAROC.
11.2 Hotels
The client should refer to the detailed description of the establishment for any other rules applicable to their trip. The client must be at least 18 years old to book a hotel on www.igolfmorocco.com.
It should be noted that hotels booked by CADDY MASTER MAROC for its clients are not exclusive to it. CADDY MASTER MAROC cannot be held responsible for any restrictions on services due to the arrival of other clients or their activities.
CADDY MASTER MAROC is not responsible for information about hotels presented on the website provided by CADDY MASTER MAROC ; flight schedules are for informational purposes only.
All departure/arrival times on the flight ticket are provided by the respective airlines and are only estimates. Times can change due to air traffic control restrictions, weather conditions, operational or maintenance requirements, and passenger check-in times.
CADDY MASTER MAROC is not responsible for changes in departure or arrival times compared to the initially communicated or indicated times on the ticket or any other flight changes by the airline.
Furthermore, when a flight segment (e.g., outbound) is not used, other segments (e.g., return) may be canceled without notification. In this event, CADDY MASTER MAROC cannot assume responsibility for any costs incurred by the client.
For all air travel, it is the client's responsibility to check the departure and arrival times of their flights at the time of travel.
For this reason, the client must confirm their flights with CADDY MASTER MAROC according to the confirmation deadline of the concerned airline.
CADDY MASTER MAROC cannot implement special procedures if the client arrives late at the airport; these matters are solely at the discretion of the concerned airline. The times listed on the ticket or itinerary are the flight departure times. Check-in times, as recommended by the carrier or airline schedules, are the latest times passengers can be accepted, including the time needed to complete all formalities. Flights cannot be held for late passengers, and CADDY MASTER MAROC cannot be held responsible in such cases.
11.3 Taxes, Fees, and Charges Imposed by the Government
The flight price may include taxes, fees, and charges imposed on air transport by government authorities. They can represent a significant portion of the cost of the trip and are either included in the ticket price or listed separately on the ticket. The client may also be required to pay taxes, fees, or charges that have not already been collected.
In some cases, departure taxes are payable locally to the Government of the country from which the client is departing and cannot be refunded by CADDY MASTER MAROC.
11.4 Boarding Denial, Flight Cancellation, or Delay
In the event of boarding denial, flight cancellation, or delay, the client should first file a complaint directly with the airline.
11.5 Seat Allocation
CADDY MASTER MAROC has no control over airline seat assignments. If the client has specific seating requests, they should check in as early as possible at the airport. CADDY MASTER MAROC cannot guarantee that the client's requests will be met.
11.6 Luggage
Clients are typically allowed to have one checked bag and one carry-on bag free of charge, except for low-cost airlines. This varies depending on the airline, class, and/or route. Clients should minimize carry-on luggage.
Clients may be charged additional fees for checked luggage beyond the allowed limit. Clients should inquire with the airline for more information (for more details: http://www.iata.org/bags).
For security reasons, clients should not carry dangerous items in their carry-on or checked luggage. Such items include compressed gas, corrosive substances, explosives, flammable liquids or solids, radioactive materials, oxidizers, poisons, infectious substances, and briefcases with built-in alarm systems.
Specific regulations apply to liquids carried in cabin luggage.
11.7 Direct Flights
It should be noted that the term "direct" on the ticket does not necessarily mean the flight will be non-stop, but only that the client will not need to change planes during their journey.
11.8 Pregnancy and Children
Some airlines refuse to transport women who will be 28 weeks pregnant or more at the time of the return journey. Clients should contact the airline directly, which might have different rules, and should also consult their physician. Infants must be at least 6 weeks old to fly and must either sit on an adult's lap or in a child seat.
Clients should seek more information from their travel advisor and contact the airline they wish to travel with for more details regarding appropriate seating. Generally, children aged 2 years or older must occupy a full seat.
ARTICLE 12 – CLIENT BEHAVIOR
Clients are advised to familiarize themselves with the rules, laws, and customs applicable in their destination(s). Clients must always comply with the rules applicable in each of the countries and regions of their itinerary throughout their stay, as well as all rules related to entering and exiting the territories concerned.
CADDY MASTER MAROC cannot be held responsible for any damage and/or inconvenience suffered by the client, whether caused by their behavior or that of third parties. It is the client's responsibility to ensure that they or any member of their group does not behave inappropriately or in a way that could endanger, harass, injure, or harm other people or damage property belonging to others (e.g., drunkenness or aggressive behavior) during their trip.
If their behavior appears inappropriate or is deemed inappropriate by one of CADDY MASTER MAROC's suppliers and endangers, harasses, injures, or harms others, or risks damaging property belonging to others, CADDY MASTER MAROC and/or its suppliers will take appropriate measures to ensure the safety and comfort of its clients and their property and those of its suppliers.
These measures may include terminating the trip, in which case CADDY MASTER MAROC's and its suppliers' obligations to the client will cease immediately, and the client will not be entitled to any refund or compensation for costs or fees resulting from such termination. Additionally, the client will be liable for all costs related to such termination.
ARTICLE 13 – IN CASE OF COMPLAINT
In the event of a complaint, the client should contact the appropriate supplier.
If the supplier is unable to resolve the issue to the client's satisfaction, the client can contact CADDY MASTER MAROC at +212 (0) 7 16 55 59 26 during business hours or by email at contact@igolfmarrakech.com. However, CADDY MASTER MAROC cannot intervene regarding any issues related to bookings made with low-cost airlines.
If the client's request cannot be immediately satisfied, they should inform CADDY MASTER MAROC as soon as possible by registered mail with acknowledgment of receipt.
The client should send a registered letter with acknowledgment of receipt within 30 days of their return to CADDY MASTER MAROC N°55 Boulevard Mohammed 5 Immeuble Jakap Appartement 33 Gueliz, Marrakech, stating their booking reference and providing all necessary information.
A delay in notification could prevent CADDY MASTER MAROC from processing the request and/or prevent it from conducting a thorough investigation, which could affect the possibility of receiving compensation.
ARTICLE 14 – General Rental and Sale Conditions
14.1 Equipment Reservation
14.1.1 Equipment subject to rental and sale
All equipment available for rental and sale is described on the I Golf Morocco website, provided the destination, travel dates, and characteristics of the players concerned by this equipment are specified, and subject to equipment availability during the desired period.
14.1.2 Rental or sale price
Rental and sale prices are set for each equipment range reserved by the client, for each chosen rental period or date according to our rental and sale rates indicated on the site at the time of booking. Our prices are always inclusive of all taxes based on the rates in effect at the time of booking.
Special conditions: Specific benefits may apply to early bookings, local promotions during certain periods, or last-minute offers, exclusively online.
The prices shown are subject to change at any time without notice, knowing that items will be invoiced based on the rate in effect at the time of order placement. Any order validated by a payment cannot be modified.
14.2 Payment Method
All purchases and rentals will be paid using a valid credit card at the time of booking and/or purchase.
CADDY MASTER MAROC has entered into a service agreement with PAYZONE for e-commerce, which provides all the functions necessary for managing a secure online payment service. Only credit cards issued within approved international networks by the GIE Cartes Bancaires are accepted. Any potential financial charges remain the client's responsibility.
The client hereby authorizes CADDY MASTER MAROC to charge the client's credit card for all amounts due for the entire rental period (starting on the first day of rental and ending on the last day of rental) and accessory sales, fees incurred due to delay, breakage, theft, loss, or non-return of golf equipment, and all fees payable under the terms stated in these General Rental and Sale Conditions.
CADDY MASTER MAROC will charge your credit card the total amount due for the entire rental period and accessory sales at the time of your booking. Canceled or modified reservations will result in refunds or charges to your credit card in accordance with these General Rental and Sale Conditions.
The order validated by the client on the CADDY MASTER MAROC site is made effective by the agreement of the central bank card network. CADDY MASTER MAROC reserves the right to cancel the client's reservation in case of refusal by the central bank card network. The client's bank details, protected by encryption, do not pass through CADDY MASTER MAROC's IT systems and are therefore not retained by our company.
14.3 Contract Formation
Based on the above, the reservation is concluded and becomes effective from:
The collection by CADDY MASTER MAROC of the total rental and sale amount.
The client's receipt of an electronic message confirming the rental and sale, containing the Rental Voucher to be printed and presented by the client at the CADDY MASTER MAROC counter of the selected airport.
14.4 Commencement, Provision, Receipt, and Return of Equipment
The rental takes effect when the client takes possession of the equipment from the airport or any approved delivery location and ends upon its return according to the duration indicated on the Rental Voucher printed by the client at the approved delivery location.
Clients booking more than one golf bag must ensure that other golfers concerned by this order present their valid passport and a funded credit card when receiving their equipment.
To retrieve the reserved equipment, the client must present the following documents :
- Their valid passport and national identity card.
- Their authorized, valid, and funded credit card.
- The rental voucher issued by CADDY MASTER MAROC.
Any equipment return after the return date specified on the Exchange Voucher will result in CADDY MASTER MAROC billing an additional rental day at the rate displayed at the CADDY MASTER MAROC counter.
The rental contract is only valid for the rental duration. If the client retains the equipment beyond this period without regularizing their situation, they lose the benefit of all guarantees provided in the rental contract.
In case of delay in taking possession of the equipment, the client must notify CADDY MASTER MAROC as soon as possible. CADDY MASTER MAROC will keep the reserved equipment for 12 hours. After this period, the equipment will be re-rented, with no compensation due to the client.
Failure to return the rented equipment, regardless of the reason, will result in CADDY MASTER MAROC billing the client for the full new value of this equipment at the public sale price, in addition to the rental cost.
14.5 Use of Rented Equipment
The rented equipment is intended solely for the client's use and must not be sublet or loaned, even for free.
The client is the sole judge of their ability to use the rented equipment. They certify their aptitude to use the rented equipment and commit to using it prudently, without danger to third parties, in accordance with current regulations.
The equipment offered for rent is recognized to be taken in good condition and must be returned as such. The equipment, being numbered or branded, must be returned with the same numbers and brand. Any damage, regardless of its cause, will result, in addition to the rental fee, in a payment to CADDY MASTER MAROC for replacement or repair costs, up to the maximum value of the equipment's brand-new condition.
14.6 Equipment Availability for Rental or Sale
CADDY MASTER MAROC cannot be held responsible for delays in the provision of rented or sold equipment caused by reasons beyond their control, including in cases of accidents, delays in equipment returns from previous rentals, regulatory changes, force majeure, strikes, and other similar reasons.
In such circumstances, CADDY MASTER MAROC will make every effort to provide the client with equipment of equal or superior quality, depending on available stock.
14.7 Deposit
The client may be required to provide a deposit equal to the public sale price (including all taxes) of the rented equipment. This deposit will be taken in the form of a credit card imprint. This deposit will be returned to the client upon equipment return, except in cases of repairs as indicated below.
Repairs: The client commits to paying the repair or replacement costs of the rented equipment, regardless of the cause of the repairs, except for those due to normal wear and tear. Repairs will be carried out exclusively by the lessor, at the client's expense. All equipment, tools, and accessories that are deemed technically or economically unrepairable must be paid for by the client at the replacement price, equivalent to the public sale price (including all taxes) recommended by the concerned equipment manufacturer.
14.8 Cancellation Conditions
The client has a withdrawal period of 14 clear days from the reservation date. However, this right of withdrawal cannot be exercised if the rental period has started before the expiry of the fourteen clear days.
14.8.1 Exercising the Right of Withdrawal
If the right of withdrawal is exercised within the 14 clear days, the amounts paid by the client will be refunded, minus a fee of 100 MAD TTC per bag for administrative costs. The refund is made by crediting the credit card used for the reservation transaction.
14.8.2 Cancellation Before Equipment Receipt and After the Withdrawal Period
The client can cancel their reservation at any time by notifying CADDY MASTER MAROC of their intention to cancel this reservation by email (and not by phone). In the event of cancellation, our policy is as follows :
- A minimum amount of 100 MAD TTC per bag plus any potential bank fees will be deducted from all cancellations.
- An amount corresponding to 30% of the reservation value plus potential bank fees for cancellations less than 28 days before the expected receipt date.
- An amount corresponding to 50% of the reservation value plus potential bank fees for cancellations less than 14 days before the expected receipt date.
- An amount corresponding to 75% of the reservation value plus potential bank fees for cancellations less than 7 days before the expected receipt date.
- An amount corresponding to 100% of the reservation value plus potential bank fees for cancellations less than 3 days before the expected receipt date.
ARTICLE 15 – LIABILITY
15.1 Scope of Liability
It is important to note that CADDY MASTER MAROC is a service provider. As such, CADDY MASTER MAROC is liable as a professional within the framework of the direct services it provides. Its liability can only be invoked in the event of gross misconduct or proven culpable negligence.
In this case, it is responsible for direct and proven damages suffered by the client and not for indirect damages, loss of profit, loss of earnings, or others.
15.2 Reservation Confirmation
The client must ensure that they travel with their reservation confirmations, electronic tickets, appropriate visas, and other travel documents (including passport). CADDY MASTER MAROC will in no way be responsible if a supplier refuses to provide the client with the reserved product or service if the latter does not have these documents.
15.3 Important Information on Liability Limits
Regarding international travel, CADDY MASTER MAROC's liability to the client will be limited or excluded in accordance with international conventions.
CADDY MASTER MAROC is recognized as a travel and holiday agency and, as such, does not control or manage airlines, maritime, or railway companies.
The journey may be subject to certain international conventions, notably the Warsaw Convention of October 12, 1929, and the Montreal Convention of May 28, 1999 (relating to international air transport), the Athens Convention of December 13, 1974 (relating to international sea transport), or the COTIF of May 9, 1980 (convention on international railway transport), as amended or supplemented.
The client accepts that the "Conditions of Transport" of carriers or transport companies apply during their journey.
The client acknowledges that all general sales conditions contained in the "Conditions of Transport" form part of their contract with CADDY MASTER MAROC and the transport company and that these "Conditions of Transport" will be considered as included by reference in their contract.
15.4 Events Excluding CADDY MASTER MAROC's Liability
CADDY MASTER MAROC's liability will never be engaged if the non-performance of its obligations results from:
- An unforeseeable and insurmountable action or omission by a third party unrelated to the service sold;
- Any action or omission on the part of the client ;
- A case of Force Majeure as defined by articles 268 and following of the Dahir of Obligations and Contracts.
ARTICLE 16 – WEATHER
CADDY MASTER MAROC cannot be held responsible for a disruption of the journey due to adverse or unusual weather conditions.
ARTICLE 17 – SPECIAL ASSISTANCE
If the client is disabled or has reduced mobility or requires special assistance for any reason, they must notify CADDY MASTER MAROC at the time of booking. If these requirements change before departure, the client must inform CADDY MASTER MAROC. CADDY MASTER MAROC cannot be held responsible for any losses the client may incur if it or its suppliers cannot meet the client's requirements.
ARTICLE 18 – SPECIAL REQUESTS
The client is required to inform CADDY MASTER MAROC of any special requests they may have, which will then be passed on to the appropriate supplier. However, CADDY MASTER MAROC does not guarantee that these special requests will be met as it has no direct control over how services are provided.
ARTICLE 19 - YOUR PERSONAL DATA
No personal information is collected without your knowledge. In a commitment to respecting privacy, the CADDY MASTER MAROC group ensures that the collection and processing of personal information are carried out in accordance with law n°09-08 of February 18, 2009, relating to the protection of individuals concerning the processing of personal data. No personal information is transferred to third parties. In accordance with the provisions of law 09-08, the CADDY MASTER MAROC group guarantees the user a right of access, rectification, and opposition to personal data concerning them.
